I had booked the Flat on 30 January 2012 in Tower no-3 (18th floor; 1197 sq. ft.;
@ Rs2150/sqft) at Panchsheel Wellington, Crossing Republic, NH-24, Ghaziabad. The construction of same Tower was already at completion on 22nd floor. At the time of booking, the builder didn't have the building plan approval from GDA above 11th floor.
I made the initial payment 10% (Rs 2,44,440) via cheque (as per the builder’s calculation) to book the flat under Down payment. However, I realized after few days that the booking amount has been incorrectly calculated and it was short by just Rs 20,000. I called the CRM head and informed about this short payment and he told that this short amount would be adjusted in next payment cycle and I need not to worry about.
For next course of payment, the bank has to release the amount (85%), but because of non-approval, the bank stopped to disburse.
I was in touch regularly with their office about the approval status. Two years later, the approval came in first week of June 2014, and accordingly I went to the builder for the next course of payment. I was shocked and surprised to know that they had cancelled the booking on 19th May 2014 (just around 15 days before from the approval) and didn't convey any intimation/notice to me before cancellation.
I felt cheated by the Builder and they have done a fraud with me. I asked for the reason and they handed me a cancellation letter stating the reason because of short payment of Rs 20,000 in booking amount. Now I am in nowhere situation and the builder has cancelled my booking and they are not agreeing to restore my booking with the same booking rate.
As per the argument with the builder, they are making settlement with me by saying to restore the booking by paying additional Rs1000/sqft (i.e. 12 lakh extra). and which is quite un-affordable for me. The flat rate has been almost doubled since Jan 2012.
